Process and conditions for video and media productions

This page sets out the full project conditions that apply to all video and media productions by Kaige Productions, including video production, photography, AI-generated content, print and social media content. These conditions supplement our Terms and Conditions and apply to every quotation and agreement, unless explicitly agreed otherwise in writing.

With these frameworks in place, we ensure a tight and predictable production, free from noise, delay or surprises afterwards. Clear arrangements upfront allow us to focus on what really matters: strong content that delivers results.

What is included

Every quotation for video or media productions standardly includes the following:

  • Production and delivery within the scope described in the quotation, depending on the project: recordings, editing, photography, print design, AI-generated content or social media content.
  • One revision round following delivery, as further described under "Delivery and revision round".
  • Delivery of the final product in the agreed formats and resolutions.

What is not included

The following cost items are not included in a standard quotation, unless explicitly stated:

  • Location rental, permits, parking costs, catering and other logistical costs.
  • Travel and accommodation costs outside the agreed working location.
  • Stock photography, stock video, music licenses or other royalty-free or paid media assets.
  • AI credits, subscriptions or plugin costs required for AI-generated content. These are charged separately based on actual usage or on a time-and-materials basis.
  • Talent, models, voice-overs, actors and their fees.
  • Printing costs, shipping costs and any reprints of physical print work. These are quoted separately.
  • Obtaining image rights, model releases and other permissions from participating persons or third parties.
  • Distribution, advertising budget, social media advertising or media buying.
  • Colour proofs (proof prints) unless explicitly included in the quotation.
  • Storage of project and source files for longer than three months, see "Retention period for project files".

Scope and additional work

The amounts stated in a quotation are based on the activities described and the estimated number of hours required. Activities falling outside the described scope are considered additional work. Additional work is reported in advance, including a cost indication, and invoiced on a time-and-materials basis at the hourly rate applicable at that time, in accordance with article 10.3 of our Terms and Conditions.

The content, scope and any deviations relative to the original agreement or quotation shall be considered agreed only when confirmed in writing by Kaige Productions.

Delivery of information and content

All information and content required for the production — such as shoot locations, briefings, scripts, product information, logos, print content, texts for flyers, brand assets and moodboards — must be supplied in full and in final form no later than 14 days before the start of the project. Incomplete or late delivery may result in delays, rescheduling and/or additional work.

Changes to essential starting points, such as location, conceptual direction, number of recordings or target audience, after this period fall outside the original scope and are treated as additional work.

Production phase and changes during recordings

The production schedule — number of recordings, scenes, photo sessions, locations or duration of the shoot — is set in advance in the quotation. Additional recordings, extra scenes, additional photo moments or expansions during production lead not only to additional production time, but also to a proportional increase in post-production work, such as editing, colour correction, retouching and audio mixing.

Such expansions are reasonably charged as additional work on a time-and-materials basis at the hourly rate applicable at that time.

Preparation of the recording location and visible information

The client is responsible for preparing the recording location in good time and in full prior to the start of the shoot. This includes, among other things, tidying, cleaning and presenting the spaces that will appear in shot, removing or relocating superfluous objects, and ensuring a workable set.

In addition, the client is responsible for removing, covering or rendering unrecognisable any information that may not be captured in image or sound. This includes, among other things, trade secrets, confidential documents, customer data, pricing information, screens displaying sensitive data, badges, name tags, vehicle registration plates, third-party logos and other privacy-sensitive or commercially sensitive information.

If during the shoot it appears that the location is insufficiently prepared, or if such information has nonetheless been captured in image or sound, Kaige Productions may remove, mask or edit these elements in post-production. Such activities fall outside the original scope and are treated as additional work, charged on a time-and-materials basis at the hourly rate applicable at that time. Kaige Productions is not liable for the unintended capturing or, following approval of the final product, the continued visibility of such information.

Image rights and permissions

The client is fully responsible for obtaining and properly documenting image rights, model releases and other permissions from all participating persons captured in image or sound. This applies equally to employees, customers and external participants.

Upon request, Kaige Productions can assist by supplying a workable template contract. The actual signing, archiving and management of these permissions remains the full responsibility of the client. Kaige Productions is not liable for any claims or damages arising from the absence of the necessary permissions.

AI-generated content

For productions involving the use of generative AI tools, the exact final result cannot be guaranteed in advance. AI output depends on the chosen tool, the available model and the input. Iterations are part of the process; a reasonable number of iterations is included in a quotation, beyond which the time-and-materials basis applies.

AI credits used, subscriptions or plugin costs are charged separately based on actual usage. The client is responsible for the final assessment of whether the material is suitable for its intended use, and bears responsibility for compliance with applicable regulations regarding AI-generated content, including disclosure, transparency obligations and any intellectual property claims.

Print

Final approval of print-ready files prior to dispatch to the printer is the responsibility of the client. Following written approval of the proof, Kaige Productions' liability for typesetting, language or layout errors lapses.

Colour differences between screen and printed result fall within the normal tolerance of the printing process and do not constitute grounds for complaint.

Delivery and revision round

Delivery shall be understood as: the moment at which we make the final product — video, photography, print-ready files, AI content or social media content — available to the client for review in writing by email, or via a download or preview link.

Every quotation includes one (1) revision round. This revision round is exclusively intended for minor adjustments and optimisations within the delivered work, such as textual corrections, minor colour or trim adjustments, limited editing changes or the replacement of individual images.

What does not fall within a revision round

  • Complete re-editing or restructuring of the final product.
  • Changes to concept, style or approach.
  • Adding new scenes, recordings or images.
  • Changes based on new insights or feedback from third parties after approval of the concept.
  • Reshoots or additional production days.

Revisions must be submitted in full and bundled in writing within 14 days after delivery. If no written revisions or objections are received within this period, the delivered work shall be deemed tacitly accepted, formally delivered and the final amount shall be invoiced in full. Revisions or changes following (whether tacit or explicit) acceptance fall outside the scope and are treated as additional work.

Distribution and own channels

Upon delivery of video content, a Kaige Productions Vimeo, YouTube or comparable media player account may be used for preview or delivery purposes. This link is expressly not intended for public distribution, embedding on websites, social media or long-term use by the client, as it concerns our own channel and we may take the material offline or modify the account at any time.

The client is required to download the source file, in the agreed quality and format, correctly upon delivery and to archive it under their own management. For publication or distribution, the client must upload the file to their own channels, such as their own YouTube account, Vimeo account, hosting environment or social media accounts.

Kaige Productions is not liable for loss of reach, view statistics, embeds or links if our preview link is at any time modified or removed.

Retention period for project files

Following delivery of the final product, Kaige Productions retains the raw data, image files, project files and edits used and produced for a period of three months, in accordance with article 9.7 of our Terms and Conditions. After this period has expired, these files may be deleted without further notice, unless other arrangements have been agreed in writing in advance.

If the client wishes longer storage of source or project files, this can only be arranged on a time-and-materials basis and under further conditions to be agreed. The client is expressly advised to archive the delivered final product as well as the source files themselves upon delivery.

Portfolio use by Kaige Productions

Kaige Productions is entitled to use the delivered work, in whole or in part, without prior consultation, for its own portfolio, marketing and communication purposes. This includes, among other things, our website, social media, showreels, pitches and advertising material.

If the client objects to such use, this must be agreed in writing in advance, where appropriate against an additional fee for exclusivity.

Cancellation and rescheduling

If an accepted and scheduled project is cancelled or rescheduled by the client within 7 days prior to the agreed (first) production date, Kaige Productions is entitled to charge 50% of the agreed project costs. This serves as compensation for reserved production time, blocked planning, preparatory work and any commitments already entered into with third parties.

In the case of cancellation or rescheduling with a notice period exceeding 7 days, the activities performed and costs incurred up to that moment will be invoiced.

Liability and client responsibility

The client is responsible for the accuracy, completeness and lawful use of all supplied content, including texts, logos, product information, prices, claims and any third-party rights. Kaige Productions does not verify this content for legal validity, copyright or substantive correctness.

Any claims or damages arising from supplied content or the absence of necessary permissions fall entirely under the client's responsibility.

Our liability is at all times limited in accordance with article 6 of our Terms and Conditions. We are not liable for indirect damages, consequential damages, loss of revenue, loss of data, reputational damage or damages arising from publication or distribution by the client.

Planning and delivery

Delivery dates are indicative and dependent on the timely supply of content, briefings, feedback and approvals. Delays in delivery may result in postponement of the planning without liability for damages or loss of revenue.

For weather-dependent production, such as outdoor recordings, Kaige Productions reserves the right to reschedule in consultation if weather conditions render the recordings impossible or irresponsible.

Acceptance, payment terms and terms and conditions

Every quotation and all agreements you enter into with Kaige Productions are subject to the Terms and Conditions of Kaige Productions, available at www.kaigemedia.nl/terms-and-conditions. Acceptance of a quotation takes place by means of one of the following actions: (1) signing the quotation document, (2) payment of (part of) the invoice amount, or (3) written confirmation by email. By accepting, you also agree to the Terms and Conditions and to the project conditions set out on this page.

For project-based work, you will receive an advance invoice of 50% of the quotation amount upon acceptance. The remaining 50% will be invoiced upon delivery, with a payment term of 14 days. For subscriptions or ongoing content productions, invoicing and payment take place in advance per agreed term (monthly, quarterly or annually).

Questions or deviating arrangements

Do you have questions about these conditions, or would you like to make different arrangements on specific points? Please contact us before signing the quotation at ln.egiakobfsctd-953d1f@ofni. Deviating arrangements will only become effective when confirmed in writing by Kaige Productions.
